Gerald Singleton of Singleton Schreiber Discusses Dixie Fire Lawsuits on Fox40

Singleton Schreiber managing partner Gerald Singleton appeared on Northern California’s Fox40 affiliate on September 16. “It’s so difficult,” he said. “I’ve spoken with and represented thousands of fire victims over the years, and while all of their stories have a lot in common, all of them are unique. Everybody’s loss is unique.” Singleton said PG&E is so far behind in protecting the grid that they can’t keep up. “It just was a case of negligence,” he said. “It’s just tragic.”

Singleton said PG&E knew that they were dealing with a high-risk area, but they didn’t act decisively enough. “Why they didn’t shut the power off really is beyond me, and I think it’s going to be shown that they were negligent — and as a result, our clients will be able to recover their damages.”

Dixie Fire Compensation Available Through AB-1054

Assembly Bill 1054 (“AB 1054”), also known as the California Wildfire Fund (the “Fund”), was signed by Gov. Gavin Newsom in July 2019. The Fund provides the state’s investor-owned utility companies $21 billion in insurance protection. The Fund protects a utility company from bankruptcy by helping pay for wildfire damages that exceed $1 billion. AB 1054 was created to encourage utility companies “to invest in safety and improve safety culture to limit wildfire risks and reduce costs,” and in return, the utility companies receive financial protection.

Apply for Dixie Fire Assistance

The deadline to apply for disaster assistance from the Federal Emergency Management Agency (FEMA) and U.S. Small Business Administration (SBA) is Oct. 25, 2021. According to a FEMA press release, “Survivors are encouraged to file insurance claims for damage to their homes, personal property, businesses and vehicles before they apply for FEMA assistance. The easiest way to apply is online at DisasterAssistance.gov. Survivors who may need to request an accommodation or have additional questions can call the FEMA Helpline at 800-621-3362 (TTY 800-462-7585) from 4 a.m. to 10 p.m. PT, seven days a week.

PG&E Report to California Public Utilities Commission

Dixie Fire PG&E Report Transcript — Read the report issued to the California PUC about the origin of the Dixie Fire. The report states that a PG&E troubleman observed what he thought was a blown fuse in a densely forested area of Butte County on the morning of July 13 at approximately 7 a.m., but he could not get to the site until around 3:40 p.m. due to “challenging terrain and road work resulting in a bridge closure.”

The report continues, “There he observed two of three fuses blown and what appeared to him to be a healthy green tree leaning into the Bucks Creek 1101 12 kV conductor, which was still intact and suspended on the poles. He also observed a fire on the ground near the base of the tree.” View the PG&E report for more.

PG&E Charged: Shasta County DA Announces 31 Charges Against PG&E Over Zogg Fire

September 24, 2021: PG&E Charged With Manslaughter in Shasta County Fire that Killed Four

According to the LA Times, “The Shasta County district attorney’s office has filed 31 criminal charges against Pacific Gas & Electric for its role in the 2020 Zogg fire, which killed four people and destroyed more than 200 buildings last year, officials announced Friday.

The charges include 11 felonies and 20 misdemeanors, as well as multiple enhancements, District Attorney Stephanie Bridgett said. The filing includes manslaughter charges for the deaths.

As the Singleton Schreiber Dixie Fire Lawsuit against PG&E ramps up, PG&E is still facing pressure from Zogg Fire litigation. The Zogg Fire burned for two months in Shasta County during the fall of 2020. Singleton Schreiber launched its first of three Zogg Fire complaints in San Francisco Superior Court on December 23, 2020, presided over by the same judge who heard our Kincade Fire litigation.

CA bans insurance cancellations on homeowners affected by Dixie Fire for one year

September 19, 2021: State halts insurance cancellations for 1 year in major wildfire areas

Just days after Singleton Schreiber filed two Dixie Fire lawsuits against PG&E, the state of California has imposed a one-year ban preventing fire insurance carriers from dropping homeowners who live in areas including those affected by the Dixie Fire and other major wildfires.

Insurance Commissioner Ricardo Lara announced the 12-month moratorium on September 19 — he said it will protect 325,000 homeowners in 22 counties keep their insurance for at least another year.
